Notice Pleading Restoration Act of 2009
S. 1504 — 111th Congress (2009–2010)
- Keywords
- supreme court, judiciary, law
- Summary
- The intent of this bill if to effectively overturn two recent Supreme Court decisions, Iqbal v. Ashcroft and Bell Atlantic Corp. v. Twombly. These decisions made pleading requirements, which must be met in order to bring a case to court, more stringent and difficult to meet. The bill has led to some strange bedfellows opposing it. The Chamber of Commerce released a letter signed by other large business organizations, but also groups devoted to civil justice. The NAACP testified in favor of the bill, and the National Senior Citizen Law Center wrote a letter in support. (by CRS)
